1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and TheIndianSoftware.com ("Company", "we", "us", or "our"), governing your download, installation, and use of the Dolphin AI - Poster Maker & AI Video Studio mobile application and related web APIs (the "Application" or "Services").

By installing, accessing, or using the Application, you represent that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the Application and uninstall it from your device.

2. Eligibility & Account Security

To use Dolphin AI, you must be at least 13 years of age (or 16 years of age in the European Economic Area). If you are using the Application on behalf of a business, corporation, or entity, you represent and warrant that you have full legal authority to bind that entity to these Terms.

• Account Authentication: You may sign in using your Google account or Apple ID via Firebase Authentication. You are solely responsible for maintaining the confidentiality of your account credentials.
• Guest Mode: When using guest mode, your virtual credits and creation history are tied locally to your device token. Switching devices or clearing application data may result in the loss of guest entitlements; creating an authenticated account is recommended to preserve your credit ledger permanently.

3. Nature of Generative AI Technology

Dolphin AI harnesses advanced neural network diffusion models (including Kling 3.0 Turbo and specialized advertising poster generators) to synthetically generate 720p commercial video animations and high-resolution marketing artwork.

• Algorithmic Generation: All outputs are generated algorithmically based on your uploaded input media, style preferences, and text prompts. Due to the stochastic nature of artificial intelligence, outputs may occasionally exhibit subtle visual anomalies or variations.
• Typography Best Practices: As disclosed in our guidelines, AI video diffusion models synthesize images continuously across video frames and are optimized for visual shapes and logos. We recommend short, bold words (e.g. "50% OFF", "SALE", "GRAND OPENING") for crystal-clear 3D printing.

4. Intellectual Property & Commercial License

• Your Uploads: You retain 100% intellectual property ownership of all product photographs, trademarks, brand emblems, and copyrighted assets you upload to the Application.
• Commercial Use of Outputs: Subject to your compliance with these Terms, we grant you a worldwide, perpetual, royalty-free license to commercially display, advertise, distribute, monetize, and broadcast the final posters and videos rendered through your account for business ads, social media campaigns (Instagram, TikTok, YouTube Shorts), e-commerce listings, and marketing promotions.
• Dolphin AI Assets: The Application's proprietary software, user interface design, logos, template prompts, and underlying code remain the exclusive property of TheIndianSoftware.com and its licensors.

5. Acceptable Use Policy & Content Restrictions

To ensure safety and compliance with Google Play Developer Policies and the Apple App Store Review Guidelines, you agree NOT to use Dolphin AI to generate, upload, or promote:

• Non-Consensual Imagery & Deepfakes: Photos or likenesses of real individuals uploaded without their explicit informed consent.
• Unlawful, Defamatory, or Hateful Material: Hate speech, harassment, discrimination, gratuitous violence, terrorism, or sexually explicit content.
• Intellectual Property Infringement: Uploading logos, brand assets, or copyrighted photography belonging to third parties without lawful trademark ownership or authorization.
• Deceptive & Fraudulent Advertising: Deceptive marketing materials, scams, counterfeit products, or fraudulent promotional schemes.
• Reverse Engineering: Decompiling, reverse engineering, scraping, or attempting to extract proprietary API endpoints, model parameters, or source code.

Violation of this section results in immediate and permanent account termination, forfeiture of virtual credits, and potential referral to relevant legal authorities.

6. Virtual Credits System

Dolphin AI operates on a transparent, digital utility credit mechanism:

• Credit Consumption Rates:
  • AI Marketing Posters: 5 Credits per generated image.
  • 720p 3D Commercial Videos: 5 Credits per second of video duration (e.g., a 5-second video costs 25 credits; a 10-second video costs 50 credits). Duration is rounded up to the nearest whole second.
• Utility Token Nature: Credits are non-monetary virtual tokens designed exclusively to allocate cloud compute resources within the Application. Credits carry no real-world cash value, accrue no interest, and cannot be refunded or transferred to another user.
• Automatic Refund Guarantee: If an AI generative job fails due to provider network interruption, system timeout, or model rejection, our backend automatically and immediately refunds the full deducted credits back to your account ledger.

7. Google Play Billing & Apple In-App Purchases

All financial transactions for credit packages and VIP subscriptions are processed exclusively through authorized platform billing systems:

• Google Play In-App Billing: On Android devices, all payments are governed by the Google Play Terms of Service. Purchases are charged to your Google Play account payment method.
• Apple In-App Purchases & Apple Pay: On iOS devices, all transactions are processed via your Apple ID account in compliance with Apple’s Media Services Terms and Conditions.
• Price Changes: We reserve the right to modify digital package prices or credit offerings at any time. Any price changes will not retroactively affect previously purchased credits or active billing cycles.

8. Subscriptions, Renewals & Refund Policy

• How to Cancel Subscriptions:
  • Android Users: Open the Google Play Store app > Tap Profile Icon > Payments & Subscriptions > Subscriptions > Select Dolphin AI > Tap Cancel Subscription.
  • iOS Users: Open device Settings > Tap your Apple ID Name > Subscriptions > Select Dolphin AI > Tap Cancel Subscription.
• Refunds: Because digital credits and compute resources are provisioned immediately upon transaction confirmation:
  • Payments are non-refundable through our servers directly.
  • To request a refund for an erroneous Google Play or App Store charge, you must submit a formal refund request directly to Google Play Support or Apple Support according to their established refund policies.

9. Ephemeral Processing & Zero File Storage

As set forth in our Privacy Policy, Dolphin AI operates under a Zero Permanent Storage Architecture for user-submitted media.

Uploaded photos, product shots, and logos are held in volatile runtime buffers solely for the execution of the requested AI model and are automatically purged upon generation completion. Users are responsible for downloading and archiving their final generated creative videos and posters to their local storage.

10. Disclaimer of Warranties

THE APPLICATION AND ALL GENERATIVE AI CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THEINDIANSOFTWARE.COM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR COMMERCIAL PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF ARTIFICIAL INTELLIGENCE OUTPUTS. WE DO NOT GUARANTEE THAT THE APPLICATION WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEINDIANSOFTWARE.COM, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS REPUTATION) ARISING OUT OF OR IN CONNECTION WITH:

• Your access to, use of, or inability to access or use the Application;
• Any visual outputs or materials generated by the AI models;
• Unauthorized access, alteration, or transmission of your content;
• Any third-party conduct or content on the platform.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY THROUGH THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Governing Law, Dispute Resolution & Support

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Jaipur, Rajasthan, India.
